"It seems clear that you have no intention whatsoever addressing your alcoholism or accepting any support, therefore it is inevitable that you will receive a sentence of imprisonment.

Ed Beltrami, prosecuting, said it was accepted Jones had done no more than drink from a can of lager in the Tesco car park.

Staff called the police but when officers arrived he threw a punch, was wrestled to the ground and was taken to the police station.

The judge commented the 50-year-old of no fixed abode, appeared to resent police enforcing the Asbo.

Vincent Yip, defending, said his client had simply been minding his own business drinking a can of Fosters.

There was no suggestion that he had bothered any member of the public or staff at Tesco. It was not until he was confronted by the police that he showed any aggression.

His personal background was a sad state of affairs - a marriage breakdown and the loss of his family, which was why perhaps he had sought solace in alcohol.
